Polka Dot Sky Software (also “us” and “we”) is a company providing Software as a Service (SaaS) solutions that empower organizations to deliver actionable information, alerts, and reminders personalized for each citizen.
We collect data from you so that we can gather and organize data from one or more content sources, help you to request support from your local government or other partner, and also so that we can personalize your experience. Some of this data may be considered personal data, which you can choose not to provide with the understanding that in doing so you may not be able to receive the full benefit of our Services. We also collect information that helps us maintain and improve the reliability and performance of our software.
We collect data when you use our apps and websites or receive Services from us. This includes information you provide to us directly, though our apps, websites, email, feedback, or any other method in which you use, customize, personalize or receive our Services. We collect information in the following ways:
Information Provided By You. You may choose to provide us with information, some of which may be personal data, when you interact with the Services in the following ways:
Automatic Collection. We collect certain information through automated means. Some information we collect through automated means may, alone or combined with other data, be personal data. For example, we may automatically collect:
Location Information. We collect location information to provide you with location-based services (such as residential services schedules, service reminders, and service updates) through our websites and mobile applications, and to conduct analytics to improve the Services. The ways in which we collect location information, and the type of location information we collect, depend on the devices you use to access the Services, and the settings for those devices. We and our content and technical partners (see Our Partners for more information) may collect location information through the Services and may share it to deliver the Services.
If you are accessing the Services through the Site, we may detect your general location so that we can automatically show you information you’ve requested for your general area. Depending on browser type and configuration, your browser may inform you that the Site would like to collect your specific location and request your permission to do so. If you do not allow it, or your browser does not permit it, only your general location information is then collected and may be stored locally on your device. Even if we are unable to collect direct location information on your device, you may manually enter a location (such as city, postal code, and country).
If you access the Services on your mobile device, we may, depending on your application and operating system settings, directly collect precise geographic location information and sensor data via Global Positioning System (GPS), cellular network information, and other location-based features. Depending on your mobile device’s operating system, we typically receive the latitude and longitude of your mobile device, as well as date and time and sensor data such as altimeter. The precision of latitude and longitude varies greatly and is determined by various factors including those controlled by your device, operating system, or mobile service provider.
If you allow any of our mobile applications to directly collect location information while the mobile applications are running in the background, you will enable continuous location collection. This may allow us to send you alerts relevant for the area in which you might be travelling. We also use this location information to conduct analytics and improve the Services.
You can turn off direct location collection (or, on some operating systems, continuous direct location collection) through your device settings or by deleting the mobile application from your device. If you turn off location-based services, you may continue to receive alerts for locations that you have selected within the Services.
Alerts and Notifications. Certain Services offer you the ability to receive push notifications for reminders, updates and alerts that you have requested. To provide these Services, we may need to collect your e-mail address, phone number, device information, and/or mobile carrier information, in addition to the geographic area to which the alert, update, or notification pertains. If you no longer wish to receive these types of notifications, you may opt out by turning them off within the settings of your mobile device or the particular Service for which you registered, or by deleting the application.
We store data that you give us (like an address you care about), that we collect from your device (like the version of your operating system), and that we generate to personalize your experience (like what types of information you access the most) on our servers. We may also store support tickets, emails and physical mail received from you, and notes about any conversations we have with you on the phone in our support tracking systems and email servers. Finally, we store cookies through your browser and tokens on your mobile device to help manage your experience when using our Services.
More About Cookies. Cookies are useful because they allow a website to recognize a user’s device. Cookies are text files containing small amounts of information that are downloaded to your computer or mobile device when you visit a website and stored within your browser. Cookies are then sent back to the originating website on each subsequent visit to that website or to another website that recognizes those cookies. Some cookies on our Services collect IP and MAC addresses, which may be considered personal data in some jurisdictions. You can find more information about cookies at www.allaboutcookies.org.
The cookies used on this website can be categorized in the following ways:
You have the right to block or delete cookies through your browser, such as Internet Explorer, Chrome, Firefox, or Safari. Please note, however, that without some cookies you may not be able to take full advantage of all the Services and some parts of the Services may not function properly.
We will retain your information for as long as needed to provide and develop the Services. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may retain information that no longer identifies you indefinitely.
We have put in place physical, electronic, and managerial procedures intended to protect your data. We store your data in a secure environment and encrypt all data transmitted to or from our websites and mobile applications, once you have logged in, using Secure Socket Layers (SSL). We also use SSL for transmissions between us and our partners, and may also apply additional layers of passive and active security to further limit the potential for unlawful accessing of data we collect, store, send, or receive.
While we take every precaution to prevent your data from being unlawfully accessed, we cannot guarantee that your communications with the Services will never be unlawfully intercepted or that your data will never be unlawfully accessed by third parties. Any transmission of information is at your own risk.
We share only the minimum data required for the Services to be delivered (like responding to your requests and preferences or for a feature to work). In many cases, this does not require sharing personally identifiable data (like an address) at all. In other cases, personally identifiable data (like your vehicle license plate) may be reviewed by a Content Partner (like a local government) before allowing you to enroll in a specific information or alert program or may be required to share to gather content or functionality you request when using the Services. Data that we provide to our partners becomes protected by their privacy and data policies.
We have both Content Partners and Technical Partners. Content Partners, for example a local government, provide us with data that we use to give you personalized and actionable information, like residential service routes and schedules. Technical Partners enhance functionality in our software (like displaying a personalized map or sending an SMS) and help us to improve our Services (like alerting our team when an error occurs or providing analytics that help us identify issues that may not have been reported).
We may also share any information collected from the Services – including aggregated or statistical data that we may generate from such information – in the following ways:
Technical and Content Partners. When your data is collected on the Services, it may be shared with selected third parties who assist us with our business operations, with the provision of the Services, with our marketing or advertising campaigns, or in delivering you the features and functionality that you have requested (“Third-Party Service Providers”, “Technical Partners”). These Third-Party Service Providers include, without limitation, companies that provide data storage, support customer service, assist with audience research and product development, and facilitate or deliver materials to you via e-mail, other electronic communications platforms, or postal service. We also may provide your data to third-party mapping service providers to provide you with map content for the Services. Third-Party Service Providers are authorized to use the data that we provide to them only to carry out the service they are providing for us.
Some of the Services may integrate and share certain information that does not reasonably identify you or your device with third-party services that you may want to use in order to determine if the services or offers make sense for you and are available in your general area. For example, if it’s raining at your location, we may present you with tools that allow you to request a ride or have food delivered; if you’re looking at the weather forecast for a vacation destination, we may present you with tools that allow you to book flights or lodging. If you want to take advantage of the service, you can choose to share additional information to do so. We do not control these third-parties’ data practices, and their collection, use, and sharing of the information is governed by their respective privacy policies.
Subject to applicable local law, we, our affiliates, or our Third-Party Service Providers may disclose your data without your permission (i) pursuant to judicial or other government subpoenas, warrants, or orders or otherwise to comply with law; (ii) where we believe an individual’s rights, property, or safety or security is at risk; (iii) if we find that your actions violate any of our legal rights; or (iv) where otherwise required or permitted by applicable law (which may include a lawful access request by U.S. or foreign courts, governments, or law enforcement agencies).
At any time you may change your preferences and settings by using the Services to update your contact methods and delivery options. You may even cancel your account completely, by emailing email@example.com providing your username. (We may require additional information from you prior to deleting your account to confirm your ownership of the account.)
You can request to access, obtain a portable copy of, correct, or delete data related to your stored preferences and your use of the Services. Email firstname.lastname@example.org initiate this process.
In the event that you consider our processing of data related your use of the Services not to be compliant with the applicable data protection laws, you can contact us at email@example.com.
We are committed to protecting the safety and privacy of young people using the Internet. We do not knowingly collect personal data from children under age 13. We believe that children should get their parents’ or guardians’ consent before giving out any personal data. If you become aware that we have collected personal data from a child without parental consent, please notify us promptly at firstname.lastname@example.org. If we become aware that a child under age 13 has provided us with personal data without parental consent, we will take steps to remove such personal data.
The Services are hosted on servers inside the United States. If you are located in the European Union or elsewhere outside of the United States, information that we collect will be processed and stored in the United States, a jurisdiction in which the data protection and privacy laws may not offer the same level of protection as those in the country where you reside or are a citizen. Subject to applicable law, by using our Services and providing information to use, you consent to the transfer to and processing of information in the United States and other jurisdictions. Where necessary under applicable law, we may employ appropriate cross-border transfer methods governing personal data.
